We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time

Cancellation and Termination

IBIRDS SOFTWARE SERVICES PRIVATE LIMITED believes in helping its customers as far as possible, and has therefore a liberal cancellation policy. Under this policy:

  1. The account owner is the only person who can cancel an account. You are solely responsible for properly canceling your account. Any email/ phone/ contact request to cancel account will not be entertained. Please ensure that the cancelation requests are made only through the online control panel.
  2. All of your Content will be immediately deleted from the Service upon cancellation. This information cannot be recovered once your account is cancelled.
  1. If you cancel the Service before the end of your current paid up year, your cancellation will take effect immediately and you will not be charged again.
  1. You can review the most current version of the terms of service at any time on this page. 
  1. Violation of any of the terms and conditions below will result in the termination of your account. While IndiCRM prohibits certain conduct while using the services, you understand and agree that IndiCRM cannot be responsible for content posted by you or other users of the services (user content). You agree to use the services at your own risk.

Payments, Refunds, Upgrading and Downgrading Terms 

  1. No refunds will be made from IndiCRM on any of the Monthly, Quarterly and Yearly plans.
  2. A valid credit card is required for paying accounts.
  3. Paid Plans: Monthly subscription: Indi CRM monthly subscription is a month-to-month, pay-as-you-go service. You will be billed for every 30 days of service. You may cancel our service any time and you won’t be charged again, but you are solely responsible for the charges already incurred. Yearly and quarterly subscription: Since we offer generous discounts for our yearly and quarterly plans, we offer no refunds on these plans. You may cancel the service anytime and you won’t be charged again. You are, however, solely responsible for the charges already incurred. 
  4. For any upgrade or downgrade in plans, your credit card will automatically be charged with the new plan rate on and from your next billing cycle 
  5. Downgrading your Service may cause the loss of content, features, or capacity of your account. Indi CRM does not accept any liability for such losses.

Copyright and Ownership

  1. Indi CRM or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any aspect of the Service which Indi CRM or its suppliers own. 
  1. Indi CRM claims no intellectual property rights over the Content you upload or provide to the Service. However, by using the Service to send Content, you agree that others may view and share your Content. 

General Conditions

  1. You understand that Indi CRM uses third party vendors and hosting partners to provide necessary hardware, software, information, networking, storage, and related technology to run the service.
  2. You may not use the service to transmit any viruses, worms, or malicious content.
  3. Indi CRM, its affiliates and its sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.
  4. Indi CRM may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
  5. The Terms of Service sets forth the entire understanding between you and Indi CRM as to the Service, and supersedes any prior agreements between you and Indi CRM (including, but not limited to, prior versions of the Terms of Service).

IndiCRM Privacy Commitment

iBirds has worried about customer and user privacy for almost 15 years, long before it became fashionable, politically correct, or legally binding to take such a position. We ask for only the least amount of information necessary, gathering only what we believe is essential for doing business, or for the specific transaction at hand. We let customers know the information we have on them and allow them to opt out of specific engagements. But, by far, our biggest commitment is that we do not make a single dollar from advertising revenue—never have, never will—even from the free editions of our products. This means we avoid the fundamental conflict of interest between gathering customer information and fueling advertising revenue, and the unavoidable compromises in customer privacy that it brings.

The goal of this policy is to make explicit the information we gather, how we will use it, and how we will not. This policy is unfortunately longer than we would like, but we must unambiguously address all the relevant cases. We will try and keep the language simple and direct as much as possible.

Scope of this Privacy Policy

This Privacy Policy applies to all iBirds websites that link to it. It also applies to the products and services provided by IBirds through these websites, our mobile applications, and applications posted by IBirds on IBirds’s online marketplace and in other third-party online marketplaces. This Privacy Policy does not apply to any of our websites, products or services that have a separate privacy policy.

Part I – Information IBirds collects and controls  This part deals with how IBirds collects and uses information about website visitors, potential customers, users of IBirds’s products and services, and others who contact IBirds through forms or email addresses published on or linked to our websites.

Part II – Information that IBirds processes on your behalf This part deals with how IBirds handles data that you entrust to IBirds when you use our products and services, or when you share any personal or confidential information with us while requesting customer support.

Part III – General This part deals with topics that are relevant to both Parts I and II, and other general topics such as IBirds’s security commitments and how we will inform you when we change this Privacy Policy.
